Alberta Energy Regulator (AER) Shut Down of Mojek Resources Inc., A Black Owned Oil and Gas Company lacks Due Process.
Mojek was issued an Abandonment Order AD 2021-004 during a meeting with AER representatives led by the Director of Enforcement & Emergency Management, Mr. Blair Reilly on the 16th of March 2021. The meeting was at the request of Mojek to inform the Director and his team on the reason why Mojek could not mobilize and complete the remediation of the site with release concerns as planned. The site in reference had been cleaned up twice by Mojek. There is no impact to public safety and environment.
Mojek believes that it was not provided due process in the build up leading to the Abandonment Order. In an earlier letter to Mojek, dated March 9th, 2021, AER indicated that if Mojek had questions it could ask the AER. Following this advice Mojek requested to have a meeting with AER to discuss its current situation and how to work with AER. AER agreed to meet with Mojek on the 16th of March 2021. To the surprise of Mojek, during the meeting, Mojek was not allowed to present its concerns, rather, the Director of Enforcement & Emergency Management, of the AER shared its screen and read out an already signed Abandonment Order. In Mojek’s opinion, the AER did not meet its offer stated in the March 9th letter. The AER also refused to hear all the pleas made by Mojek to explain its concerns. These actions have caused Mojek untold hardship and damages.
Mojek wishes to inform all her stakeholders and the public that she has requested an Appeal and Stay of Execution of the Abandonment Order. Mojek believes that it was not provided due process in the build up leading to the Abandonment Order. Mojek hopes that the Appeal will receive a quick consideration and that a stay action of the Abandonment Order will prevail.
