Calgary, Alberta – June 26, 2024 – Enserva issued the following statement regarding the recent passing of Bill C-59
Enserva and its members strongly oppose the Competition Act amendments related to environmental benefits, which were hastily added to omnibus Bill C-59. These changes severely restrict freedom of expression and open debate in Canada, silencing debate and hindering transparency. This legal shift represents a significant setback for our nation, introducing an unprecedented presumption of guilt and imposing excessive legal burdens across all sectors of the Canadian economy.
Instead of fostering meaningful public disclosure on environmental and climate performance, these measures deter responsible businesses from sharing their achievements and goals in emissions reduction and environmental stewardship. Including these amendments in an omnibus bill without proper consultation contradicts Canadians’ expectations of transparent governance.
This discouraging effect undermines investment in Canada, particularly from investors concerned with the severe penalties that the Competition Bureau can apply without any judicial oversight. Consequently, economic investment, affordability, and job creation will suffer.
Enserva member companies employ hundreds of thousands of Canadians across the country, and every day our sector finds new and innovative ways to deliver energy responsibly and with the lowest environmental impact possible. The technological advancements necessary to reduce emissions while maintaining our standard of living will be driven by our members’ efforts. This decision by the federal government makes it harder for Canadian companies who are responsibly operating to tell their story, and the effect will be to move our nation backwards, not forwards.
We call on the federal government to immediately direct the Competition Bureau to not pursue any investigations related to these amendments and commit to repealing them when the House of Commons resumes sitting this fall. Should the federal government determine the need for new regulations in this area, we call on them to do so transparently and thoughtfully, and to include all sectors of the economy in the discussion.
